NOTICE OF PRIVACY PRACTICES FOR THERAPY CLIENTS OF THE THERAPIST WITHIN SERENITY SPACE THERAPY

Note: This NPP is relevant only for clients receiving therapeutic care from the therapist(s) of The Therapist Within Serenity Space Therapy. Use of this website is not intended as therapy.

THIS NOTICE DESCRIBES HOW YOUR MEDICAL INFORMATION MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

Definition of "Medical Information"

The term "medical information" is synonymous with "personal health information" and "protected health information." It refers to any identifiable health information, whether oral or recorded, that:

  • Is created or received by me (a healthcare provider), health plan, or others.

  • Relates to your past, present, or future physical or mental health; the provision of health care; or the payment for health care.

As a Licensed Marriage and Family Therapist and a Master’s Level certified Addiction Professional licensed by the State of Florida, I create and maintain treatment records containing identifiable health information about you. These records may be referred to as "medical records" or "mental health records."

Uses and Disclosures Without Your Authorization

For Treatment, Payment, or Health Care Operations

Federal privacy rules allow me, as a health care provider with a direct treatment relationship with you, to use or disclose your personal health information without written authorization for the following purposes:

  • For Treatment:

    • Example: Consulting with another licensed provider about your condition for diagnosis or treatment.

    • Note: Disclosures for treatment are not limited to the minimum necessary standard, as full information is required for quality care.

  • For Payment:

    • Example: Providing your health records to your health plan to determine payment eligibility.

  • For Health Care Operations:

    • Example: Sharing your mental health records with your health plan for an audit to review competence, performance or detect fraud or abuse.

PLEASE NOTE: I or an authorized person in my practice may contact you for appointment reminders or to provide information about treatment alternatives or health-related benefits that may interest you. Written authorization is not required for such contact.

Your privacy and the confidentiality of your medical and mental health records are of paramount importance. This notice is designed to inform you of the ways your medical information may be used and to assure you of the protections in place to maintain your privacy. Other Uses and Disclosures Without Your Authorization

I may be required or permitted to disclose your personal health information (such as mental health records) without your written authorization under the following circumstances:

  • Court Orders: Disclosure is compelled by a court pursuant to an order.

  • Administrative Agency Requests: Disclosure is compelled by a board, commission, or administrative agency for adjudication or investigation pursuant to its lawful authority.

  • Legal Proceedings: Disclosure is compelled by a subpoena, notice to appear, or other provision authorizing discovery in legal proceedings.

  • Arbitration: Disclosure is compelled by an arbitrator or arbitration panel during lawful arbitration.

  • Search Warrants: Disclosure is compelled by a lawfully issued search warrant to a governmental law enforcement agency.

  • Patient Consent: Disclosure is compelled by the patient or the patient's representative.

  • Child Abuse or Neglect: Disclosure is compelled by the Florida Family Code if child abuse or neglect is suspected.

  • Elder or Dependent Adult Abuse: Disclosure is compelled by the Florida Human Resources Code if elder or dependent adult abuse is suspected.

  • Threats to Self or Others: Disclosure is compelled if you are determined to be a danger to yourself or others.

  • Imminent Physical Violence: Disclosure is compelled if you communicate a serious and imminent threat of physical violence against an identifiable victim(s).

  • Coroner Investigations: Disclosure to the coroner to determine the cause of death, in the event of your death.

  • Appointment Reminders and Information: I may contact you to provide reminders or health-related information, as indicated above.

  • Health Oversight Activities: Disclosure to a health oversight agency for legally authorized activities, such as audits or investigations.

  • U.S. Secretary of Health and Human Services Investigations: Disclosure is compelled to investigate or determine compliance with federal privacy requirements.

  • Other Specific Legal Requirements: Disclosure is otherwise specifically required by law.

Important Note:

  • Minimum Necessary Standard: Generally, uses or disclosures will be limited to the minimum necessary to accomplish the intended purpose. This standard does not apply to disclosures for treatment purposes, as full information is needed for quality care.

  • Revocation of Authorization: You may revoke your written authorization at any time, with limitations as described above.

  • State Law Compliance: If Florida law provides greater confidentiality or rights regarding your records, I will abide by Florida law.

PLEASE NOTE: The above list is not exhaustive and informs you of most circumstances when disclosures without written authorization may be made. Other uses and disclosures may be made only with your written authorization, even though certain exceptions apply. Feel free to consult with the practice if you need more specific information regarding the use and disclosure of your personal health information.

Your Rights Regarding Protected Health Information
